Terms of Service

Please read these Terms of Service carefully before using the GUARDED mobile application and website. The Service is operated by Abenteuergeist, Alexander Mayle, Widenmayerstraße 11, 80538 München, Germany ("the Company", "we", "us").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement and have the legal capacity to enter into this agreement.

3. Accounts

When you create an account, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding access to your device and account and for all activity that occurs under your account. You can delete your account at any time in the app settings.

4. Subscriptions and Payments

Parts of the Service are available through paid subscriptions. Subscriptions renew automatically unless you cancel them. Billing is handled entirely by the Apple App Store; we never receive your payment details.

You can manage your subscription and cancel auto-renewal at any time in your device's subscription settings (Settings, your Apple ID, Subscriptions). Cancellation takes effect at the end of the current billing period. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Refunds are handled by Apple under the App Store terms; you can request one at support.apple.com/billing.

5. Not Medical or Professional Advice

GUARDED provides faith-based encouragement, education, and habit tools. It is not therapy, medical care, or professional addiction treatment, and it is not a substitute for advice from a qualified physician, therapist, counselor, or pastor. If you are struggling with compulsive behavior, mental health issues, or thoughts of self-harm, please seek qualified professional help. Never disregard professional advice because of something you read in the Service.

6. AI Companion

The optional AI companion generates responses automatically. Responses may be inaccurate or incomplete and do not constitute professional, medical, or spiritual counsel. Use your own judgment and consult qualified people for important decisions.

7. Acceptable Use

You agree not to misuse the Service. In particular you will not:

  • violate any applicable law or regulation;
  • reverse engineer, decompile, or attempt to derive the source code of the Service;
  • transmit viruses, malware, or other harmful code;
  • interfere with or disrupt the integrity or performance of the Service;
  • impersonate any person or entity.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors and are protected by copyright, trademark, and other laws.

9. Termination

We may terminate or suspend access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

10. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages. The Company's total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim or, for free use, 100 euros. Nothing in these Terms limits liability for intent, gross negligence, or injury to life, body, or health under German law.

11. Governing Law

These Terms are governed by the laws of Germany. Mandatory consumer protection rules of your country of residence remain unaffected.

12. Changes to These Terms

We may modify these Terms at any time. Changes become effective when posted. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
